Maryland SR-22 requirements

SR-22 is a certificate or proof of financial responsibility that accompanies your regular insurance policy. It serves to reinstate your driving privileges that are lost after a traffic violation if your state or the court requires you to have it. You’ve likely heard this requirement called SR-22 insurance. While it’s not actually a different type of car insurance from your typical car insurance, it’s often called SR22 insurance because it affects your car insurance coverage and rates.

For states that require an SR-22 form, it means the driver committed a driving violation and has been required by their state or court to file it. The SR-22 insurance form is a proof of insurance and it guarantees to the state that you have the minimum amount of insurance coverages required of you and it allows you to drive in the state.

Maryland doesn’t refer to their requirement as the SR-22, but there is still a vehicle insurance certificate requirement for some drivers called the FR-19 form. Like the SR-22, the FR19 verifies to the Maryland Motor Vehicle Administration (MVA) that you have the required car insurance in the state. It’s different from SR22 because the SR22 is required after certain traffic violations and must be maintained for three years or so. The FR-19 is only valid for 30 days.

The purpose of the FR-19 form is make sure all drivers in Maryland are insured with proper car insurance coverage. If you’re unable to prove you have car insurance when you’re requested to file an FR19, you could face penalties including license and vehicle registration suspension as well as fees for lapse of insurance. If you car insurance lapsed and your license and/or registration was suspended, you’ll need to pay a fee to reinstate them once you have an active car insurance policy.

SR-22 insurance limits in Maryland

All drivers in Maryland must have at least the following auto insurance coverages:

  • Liability:

    • $20,000 bodily injury liability per person
    • $40,000 bodily injury liability for two or more people per accident
    • $15,000 to cover for property damage
  • Personal injury protection:

    • $2,500 per person
  • Uninsured/underinsured motorist:

    • $30,000 bodily injury per person
    • $60,000 bodily injury per accident
    • $15,000 property damage per accident

Failure to have car insurance in Maryland can result in license suspension, vehicle registration suspension and fees in Maryland. You may face those penalties if you’re asked to submit an FR-19 form and you’re unable to prove you have car insurance in Maryland.

Who needs an FR-19 in Maryland?

You may be asked to file an FR-19 form in Maryland to verify you have car insurance for the following reasons:

  • You registered a newly titled car in Maryland
  • Your car insurance policy has been canceled and the MVA has been notified by your insurance company
  • You switched car insurance companies
  • The MVA has done an audit and needs to verify you have car insurance
  • You have at least three points on your driving record

The purpose of the FR-19 form is to make sure uninsured drivers are kept off the road. Even though you may not be required to have SR22 insurance after serious offenses like a DUI, the state still has penalties in place for risky drivers who break the law.

A DUI is one of the most common reasons drivers need SR22 insurance in other states. In the table below, you can view average insurance rates for drivers in Maryland who’ve been convicted of a DUI.

How to get SR22 insurance in Maryland

If you’ve been convicted of a driving violation in Maryland, you may be considered a high-risk or non-standard driver. This may result in your car insurance rates to increase. Most states require an SR-22 form to be filed by certain high risk drivers guilty of violations, requiring the drivers to get SR-22 insurance. If you’ve accumulated more than three points on your driving record, you may be asked to file an FR19 form in Maryland.

Even though Maryland doesn’t require an SR22 form, drivers with violations typically associated with SR22 insurance may have a harder time finding an insurance company that will sell them a policy. In Maryland, when you let your car insurance lapse, you’ll have to pay an uninsured motorists penalty fee of $150 for the first 30 days and $7 for each day after that.
